EXCEPTIONS

Company obligations to protect the Information do not extend to information that is: (a) publicly known at the time of disclosure or subsequently becomes publicly known through no fault of the Company; (b) is disclosed by Receiving Party with Disclosing Party’s prior written approval. Company may be bound to disclose the Information to any Government institutions/authorities to the extent required (i) Under the laws, rules, and regulations and/or under orders of any relevant judicial or quasi-judicial authority (ii) To protect and defend the rights or property of the Company; (iii) To fight fraud and credit risk ; (iv) To enforce the Company’s Terms of Use (to which this Privacy Policy is also a part); (v) When the Company, in its sole discretion, deems it necessary in order to protect its rights or the rights of others; (vi) If otherwise required by an order under any law for the time being in force including in response to enquiries by Government agencies for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences; (v) to the employees and others on need to know basis; (vi) In case of sale, merger, demerger and/or reorganisation of the Company, the Information shall be transferred to the new entity or the new owner and such other new entity of any new owner shall also have the right to use your information as per this Privacy Policy.

If the User, access any third party links, advertisements etc. then we shall not be responsible for the confidentiality , safety of the Information provided by you to such third party’s through such links and advertisements.

DISPUTE RESOLUTION AND GOVERNING LAW

If any dispute, controversy or claim arises under these terms and conditions or in relation to usage or Platform or its Services , including any question regarding the existence, validity or termination of this T&Cs (hereinafter Dispute), the parties shall use all reasonable endeavours to resolve such Dispute amicably. If the parties are unable to resolve the Dispute amicablywithin 30 days of the notice of such Dispute, Company may elect to resolve any Dispute by a binding arbitration in accordance with the provisions of the Indian Arbitration & Conciliation Act, 1996 (hereinafter Act). Such Dispute shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The Dispute shall be resolved by a sole arbitrator, appointed by the Company. The seat of the arbitration shall at the office of the Company or any other place decided by the Company within the limits of the City of Gurgaon, Haryana and the language of this arbitration shall be English. All the dispute shall be settled under Indian Laws and the Courts at Gurgaon, Haryana shall have the Jurisdiction on any dispute under this Agreement.
